Terms & Conditions
These terms govern use of the cdlhr.ai service operated by GIG Invest Inc ("cdlhr.ai", "we", "us"), including the driver application messaging program described in section 2.
1. The service
cdlhr.ai lets a US trucking employer receive driver applications, have those applicants screened by an automated voice agent on a recorded phone call, and review a score derived from that call. A person employed by the employer makes every hiring decision. The software does not reject applicants on its own.
2. Driver application messaging program
We do not send text messages yet. This section sets the terms that will apply from the first message.
Program name
cdlhr.ai driver application messages.
What the program sends
Text messages to CDL driver applicants about the application they submitted through cdlhr.ai: confirmation that an application was received, notice of a scheduled or missed screening call, and follow-up about that application. Every message carries the name of the employer the driver applied to. We never message a driver about a different employer, and we never message a number that did not opt in through a cdlhr.ai application page. We send no marketing or promotional messages through this program.
Who receives messages
Only applicants who tick the separate, unticked SMS box that the application page will carry for this program. Ticking it will not be a condition of applying, and it is separate from acceptance of these terms.
Cost
Message and data rates may apply.
How often we message
Message frequency varies, depending on the stage of your application.
How to stop messages
Reply STOP to any message from us to opt out. You will receive one final message confirming that you have been unsubscribed, and we will send you no further messages. Opting out of texts also stops screening calls about that application.
How to get help
Reply HELP to any message from us for help, or email support@cdlhr.ai.
Carriers
Carriers are not liable for any delayed or undelivered messages.
Privacy
Our Privacy Policy explains what we collect and who we share it with. Mobile information and SMS consent are not shared or sold to third parties or affiliates for marketing purposes.
3. Screening calls
Screening calls are placed by an automated voice agent, which identifies itself as automated and discloses that the call is recorded before asking anything. We place calls only where the applicant gave prior express consent, and only inside legal calling hours for the applicant's location; where we cannot place that location with confidence we use a narrower nationwide window that falls inside legal hours in every continental US time zone. Consent can be withdrawn at any time, as described in our consent revocation policy.
4. Employer obligations
An employer using cdlhr.ai agrees that applicants it brings to the service applied to it directly, that it will use recordings, transcripts and scores only to evaluate applicants for the job applied to, and that it will comply with the employment and equal-opportunity laws that apply to it. Contact records that reach us any other way are never sent text messages: the messaging program in section 2 is limited to people who ticked the SMS box on a cdlhr.ai application page, and no other origin can produce a message.
5. Acceptable use
You may not use the service to send unsolicited messages, to contact anyone who has opted out, to impersonate another company, or to place calls or messages outside the described program.
6. Disclaimers and liability
The service is provided "as is" and "as available". To the extent the law allows, we disclaim every warranty not stated in these terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. A score helps a person decide; it is not a decision, and we do not promise that any applicant will be reached, will answer, or will suit a job.
To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data, and our total liability to an employer for all claims relating to the service is limited to the amount that employer paid us in the twelve months before the claim arose. Nothing in these terms limits a liability that the law does not allow to be limited, or any right a driver has under consumer protection law.
An employer will defend and indemnify us against third-party claims arising from its hiring decisions, from contact records it brings to the service, or from its breach of section 4.
These terms are governed by the laws of the State of Illinois, without regard to its conflict of laws rules, and any dispute about them is heard in the state or federal courts located in Illinois, unless the law of the place where a driver lives gives that driver the right to bring a claim there.
7. Changes to these terms
We will post any change on this page and update the date at the top. Material changes to the messaging program will be described here before they take effect.
